1. Acceptance of Terms

By creating an account or using Pixclaim, you agree to these Terms of Service. If you do not agree, do not use the platform. These terms constitute a binding agreement between you and Pixclaim.

2. Platform Description

Pixclaim is an AI-powered marketplace that connects photographers with brands seeking authentic visual content. Photographers upload photos, our AI analyzes commercial potential and matches them with brands, and licenses are issued automatically upon agreement.

3. Photographer Obligations

  • You must own or have the right to license all photos you upload
  • Photos must not infringe third-party copyrights, trademarks, or rights of publicity
  • Photos containing identifiable people require a valid signed model release
  • Photos containing identifiable private property require a property release
  • You warrant that photos are original and not AI-generated without disclosure
  • You grant Pixclaim a license to display, analyze, and sublicense your photos to brands

4. Revenue Split

Photographers receive 70% of every license fee. Pixclaim retains 30% as a platform fee. Payouts are processed via Stripe Connect and typically arrive within 2-5 business days after a brand completes payment.

5. Brand Obligations

  • Licenses are for the specific uses agreed at purchase — redistribution or resale is prohibited
  • Brands must not claim ownership or copyright over licensed photos
  • License terms and usage rights are binding for the stated duration

6. Prohibited Content

The following are strictly prohibited: illegal content, non-consensual intimate imagery, content involving minors, content that incites violence or hate speech, deceptive or fraudulent materials. Violations result in immediate account termination and may be reported to law enforcement.

7. Subscriptions and Payments

Subscription plans are billed monthly. You may cancel at any time; your plan remains active until the end of the billing period. No refunds are issued for partial months. Prices are in USD.

8. Limitation of Liability

Pixclaim is provided “as is”. We are not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the fees paid to us in the 3 months preceding any claim.

9. Governing Law

These terms are governed by the laws of the European Union and Bulgaria. Disputes shall be resolved in the courts of Sofia, Bulgaria.
